One of the most obvious options that the employee has is to just refuse to provide any biometric scan, but by refusing they can very well be fired. Because most employers are required to get written consent from the employee before they can use any of the information, the employee can refuse and not give consent, which would restrict the company to use/collect the employee biometric information.

So long as your employer does not share the information obtained from your biometric reading with any other entity, you would have a hard time preventing this measure. Searches and seizures have more to do with government acts, such as police investigations, which have higher levels of protection than do acts by private entities such as employers.

Many people believe that when placed in the wrong hands, a person’s biometric data in a biometric system can be misused resulting in severe consequences. Clearly the answer to that will be yes. You might argue that fingerprint scanning is the only way to ensure that a particular individual is clocking-in as themselves rather than somebody else doing it, which was always the problem with more old-fashioned systems.

Some courts have also ruled in favor of employees who refuse to use biometric time clocks due to religious concerns. Labor departments have also interpreted current laws in ways that restrict biometric time clocks. However, in many other states, biometric time clocks are allowed.
